City Council Approves Special Meeting Resolution

Pizza-Luce-Outdoors

The City Council adopted a resolution Tuesday approving temporary waivers to certain City Code requirements to allow restaurants greater flexibility for outdoor seating and to allow drive-in religious services.

The resolution was adopted in response to Phase II of Governor Time Walz’s Stay Safe MN plan announced Wednesday, May 20 and is designed to further aid in the support and recovery of local businesses and faith organizations.

Phase II allows for bars and restaurants in Minnesota to open for outdoor service as of June 1. Outdoor patios and serving areas will be limited to 50 patrons at a time and reservations are required.

Under the changes, existing restaurants can expand onto sidewalks, parking areas and green space. Temporary drive-up operations will be allowed and businesses will be able to administratively receive a license to serve alcohol in the temporary outdoor seating areas. Temporary sign regulations and permit requirements were also waived.

The resolution also allows faith organizations to establish drive-up or drive-in services.

Waivers are temporary until the City Council repeals the resolution or the local peace time emergency is repealed. The businesses and faith organizations are required to provide protective barriers and meet other health and safety standards, including preparing a traffic management and fire safety plan.

To be included on the city’s waiver list, businesses and faith organizations should complete the Temporary Waiver for Outdoor Business Activities during COVID-19 form.
